General Terms and Conditions of Sale

The buyer’s general terms and conditions are not recognised unless expressly agreed in writing by SARL Domaine de Saint-Eugène.

All prices apply to the specified packaging unit and include statutory VAT.

Wine tax, standard packaging, and glass are included in the prices. The applicable prices are those valid at the time the order is placed. The price list is valid from the date of publication until replaced by a new version.

The publication of a new price list automatically invalidates the previous price list.

Shipping Fees:

Standard shipping within the EU (1–12 bottles): €10

Shipping outside the EU (1–12 bottles): €28

The delivery conditions apply to 0.75L bottles.

Goods remain our property until full payment of all claims due at the time of invoicing. The buyer is only authorised to resell goods within the normal course of business.

According to Article L 133-3 of the French Commercial Code, any irregularity at the time of delivery (damage, missing items, etc.) must be handwritten on the delivery slip and signed by the buyer. The buyer must notify SARL Domaine de Saint-Eugène of the issue within three (3) business days after the delivery date and confirm the complaint as noted on the delivery slip. Claims submitted outside this timeframe will not be accepted.

Product complaints will only be accepted if received in writing within 8 days of receipt of the goods. The presence of tartrate crystals is a natural process and proof of a non-chemical wine treatment; it is not grounds for complaint.

Payment (net price plus, where applicable, shipping and VAT) must be made within 7 business days after delivery, without discount. In the event of delay, the buyer shall pay interest at a rate of 5% of the invoiced amount. If a due claim remains unpaid, all other claims arising from the business relationship become immediately payable.

Further claims for damages remain unaffected. The buyer may only offset undisputed or legally established claims. Neither party shall be held liable for failure to perform contractual obligations due to force majeure or unforeseeable events. Force majeure includes, but is not limited to: disruption of transportation or supply routes, earthquakes, fires, storms, floods, lightning, telecommunication failures, or third-party network outages. Both parties shall seek to assess the impact of such events on performance and agree on conditions for resuming contractual obligations.

The legal relationship between SARL Domaine de Saint-Eugène and the buyer is governed exclusively by French law.

The language of the contract is French.

The place of performance and jurisdiction for any claims or disputes, insofar as permitted by law, shall be the registered office of SARL Domaine de Saint-Eugène.

In the event of a dispute, the buyer agrees to first seek an amicable settlement with the company.

The prices valid at the time of ordering are binding. If a vintage is sold out, we reserve the right to supply the following vintage.

If any provision of these General Terms and Conditions or of the accompanying contract is or becomes invalid, the validity of the remaining provisions shall not be affected. The contract and these GTC shall remain fully binding for both parties.
